Noon-1:00 p.m.        Lunch & Opening Address
Mike McQueeney, Vice President & Deputy General Counsel
The Coca-Cola Company

The Coca-Cola Company (TCCC) has long been a bellwether corporate legal department, especially concerning relationships with outside counsel and its partnerships with diverse organizations. Mr. McQueeney has played a key role in the department's success and will provide an overview of where TCCC's department has been, where it's going and the value of in-house counsel.

1:00-2:00 p.m.         Panel 1: Social Media: Early Involvement, Where We’re Going, What To Do
John Campbell, Senior Counsel, FedEx Corporation
Vincent Miraglia, Chief Counsel - Litigation, International Paper
Barry Willms, Sr. Attorney + Discovery Process Architect, Counsel On Call

An esteemed panel will take a close look at this exploding topic. “Status Updates” will include: corporate social media policies and implementation; case law; employee usage and its impact on litigation; preservation, collecting and reviewing (volume, software, good and bad documents); the types of social media (Facebook, LinkedIn, Twitter etc.) and their impact on e-discovery in general (how it is going beyond private investigators and family court situations); and review platforms that handle this type of media.

Richard Stout, Sr. Attorney + Director, E-Discovery Division, Counsel On Call

As the volume of electronically stored information continues to increase, it's more important than ever to dramatically and defensibly reduce the amount of data that must be reviewed by attorneys. New products and processes continually enter the marketplace, and this panel is loaded with thought leaders driving the innovation. While this panel was already in development, the recent NY Times article on the subject has made it even more relevant (Herb is quoted throughout).

Budgeting has become an increasingly important part of the litigation/discovery process, and it begins with analyzing your company, its litigation and how work is handled. Planning and budgeting often go hand-in-hand. This panel will discuss this process and how to measure results, understand if you're doing it correctly and offer up stories of success and failure.

10:15-11:15 a.m.     Working Group 1 (seniors): IT & Legal: In-Sourcing More Work
Led by Cox Communications
Kristen Weathersby (Asst. General Counsel, Cox Communications)
Mike Lisi (Director - Litigation Support, Fidelity Investments)

Information Technology and Legal departments never used to speak the same language; today, it is vital for them to work together throughout the discovery process. Cox Communications and Fidelity Investments each have developed models and processes to efficiently manage and understand their data and custodians and address litigation as it comes in the door – with IT and Legal working collaboratively and keeping as much behind their firewall as they can. This session will highlight the history of their models and best practices.

10:15-11:15 a.m.     Working Group 2 (juniors): Big Case Coming: Which Process/Tools To Use?
Led by Southwest Airlines
Stacy Cozad (Assc. GC, Litigation) and Meredith Dugan (Paralegal)

A breakout session discussing situations with companies that handle a lot of work internally, or have smaller departments who handle everything… and then have large or “bet the company” matters hit. What do you do with that volume of data? What if you don’t have the budget to simply hand a complex matter over to outside counsel? What if you want to quickly design your own process but don’t know where to begin? Southwest and its legal team -- which is completing a merger and bringing technology in-house -- have faced these issues and will lead the discussion.

11:30-12:30 p.m.     Working Group 3 (Srs): Multi-Level Resource Utilization
Led by Fidelity Investments
Samantha Miller (Dir., Complex Discovery) and Sharmila Murthy

Fidelity Investments has developed an innovative discovery model and in recent months has taken new steps to define its division of labor and how its litigation work is handled. The company utilizes in-house attorneys and non-legal professionals, outside counsel, Counsel On Call attorneys, India and different technologies to address its sizable case load, and has achieved significant quality improvements, efficiencies and cost savings. Sam and Sharm will lead a discussion about how different departments and people work together to maximize Fidelity's results.

11:30-12:30 p.m.     Working Group 4 (Jrs): Team Leaders: Who They Are, What They Do?
Sandy Brown, Dameon Allensworth

Team Leaders are a key link in the chain of the discovery process, serving as a conduit between in-house attorneys, outside counsel, technology partners and the discovery attorneys. They track results and manage the team. They diligently track quality control.  They look for areas that can operate more efficiently and for work where more value can be provided to the client (and not just in the review of documents). In short, they can be an in-house attorney’s best friend.
